ACCEPTANCE OF TERMS
By using the Website or MindBody App, you signify your acceptance of our Terms of Service. If you do not agree to this, please refrain from using the Website or App. Your continued use of the Website or App following the posting of changes to these terms will indicate your acceptance of those changes.
TERMS & CONDITIONS
All sales are final. Memberships and packages are not eligible for refunds, transfers, or exchanges. Instructors and classes are subject to change without notice. Clients must be 16+ years old to participate in class. Clients under the age of 18 must be accompanied by an adult during the workout, and have a legal guardian's signature on the waiver to attend classes.
CLASS POLICIES
NEW CLIENTS
Please arrive at least 10 minutes before the first class for a studio and Megaformer™ orientation, and to review and sign our liability waiver contract. For your safety and the safety of other clients, new clients coming in at the start of class or later will be refused entry.
RETURNING CLIENTS
Please arrive at least 10 minutes before class. Due to COVID and for the safety and consideration of all clients, clients who arrive at the start of class will be refused entry, and if there is a waitlist you will forfeit your spot to a waitlisted client.
ALL CLIENTS
Athletic grip socks are required to participate in classes and in private and duet sessions. We have grip socks available at the studio for purchase or you can bring your own athletic grip socks. For your safety, hospital or fluffy winter socks are not proper athletic grip socks and cannot be worn during class.
Please leave your personal belongings, including your cell phone in the available lockers or cubbies at the studio. Please make sure to turn your phone on silent prior to class.
sculpt50 is not responsible for the safekeeping of your personal belongings. You assume all risk of loss for any of your personal belongings.
CANCELATION AND NO SHOW POLICIES
LATE CANCELATION
Cancelations must be done via MindBody online or app, or through logging into our website. We do not accept cancelations by telephone or email. All group classes require 12 hour cancelation notice. You may cancel reserved classes for any reason without penalty up until 12 hours prior to the scheduled class by logging into your MindBody account to cancel. Rescheduling or canceling a reserved class after the 12-hour period is a late cancellation. Clients on a membership and/or class package, including the new client specials will forfeit the class. A late cancelation 30 minutes before the start of the class is considered a no-show. We require a valid credit card on file for late cancellation fees and no show fees.
NO SHOWS
A late cancelation 30 minutes before the start of class or no attendance without canceling the class is a No Show. Clients on a membership and/or class package including the new client specials will forfeit the class and incur a $25 no show fee. Due to COVID and for the safety and consideration of all clients, returning clients who arrive at the start of class will be refused entry and forfeit their spot to a waitlisted client. We require a valid credit card on file for late cancelation fees and no show fees.
CLASS CANCELLATIONS
We reserve the right to cancel classes at any time for any reason.
The first class of the day is canceled if there are no reservations 12 hours ahead of the class. For all other classes, classes are canceled if there are no reservations 4 hours before the start of that class. We never want to cancel classes, and look forward to seeing all of you; please reserve your spot early!
LIMITATION OF LIABILITY
By signing our liability waiver contract and/or attending classes, events, and other programs and using the sculpt50 studio facilities and equipment, (individually and/or collectively, the “Classes and Facilities”) you hereby acknowledge on behalf of yourself, your heirs, representatives and/or assigns, that there are certain inherent risks and dangers in the nature of the sculpt50 workout program. You acknowledge that you have voluntarily chosen to participate in a program of physical exercise. You acknowledge that sculpt50 strongly recommends that you consult with your physician prior to commencing the sculpt50 workout program. You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You further acknowledge that the specific risks vary from one activity to another, but range from (a) minor injuries such as scratches, bruises, and sprains; (b) major injuries such as head and eye injury or loss of sight, concussions, joint or back injuries, and heart attacks; and (c) catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, rules, and verbal instructions given to you by instructors and staff. In consideration of being allowed to participate in and access the sculpt50 classes and studio facilities, you hereby (a) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the sculpt50 classes and studio facilities, (b) release, indemnify, and hold harmless sculpt50, subsidiary affiliate entities, and each of their respective members, employees and representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the sculpt50 classes or sculpt50 studio facilities, and (c) represent that you (1) have no medical or physical condition that would prevent you from properly using any of sculpt50's classes and studio facilities, (2) do not have a medical, physical, and/or mental condition that would put you in any physical or medical danger, and (3) have not been instructed by a physician to not participate in exercise. You acknowledge that if you have any chronic conditions, you are at risk in participating in sculpt50 classes and use of studio facilities, and should not be participating in any classes.
CHANGES TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Website. Your continued use of the Website and App after any such changes constitutes your acceptance of the new Terms of Service.
We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Website and App.
sculpt50 reserves the right to refuse service, remove or edit content, and/or cancel classes and orders, at its sole discretion.
